The fifth circumstance. Sometimes, there is custody that has been decided, but there is no parenting plan. For example, the state (DCS) established custody for the purpose of child support, but for nothing more. Whichever parent is receiving the child support would have been designated the custodial parent even without there being a parenting plan or residential schedule.
